A U.S. Capitol riot defendant who was accused of firing a gun into the air while among the mob on Capitol grounds on January 6, 2021, now faces charges of sexual assault and kidnapping in Utah. Prosecutors allege John Banuelos, 40, attacked a woman in the Salt Lake City area in 2018, three years prior to his alleged involvement in the Capitol siege, according to court filings obtained by CBS News. He is the latest Jan. 6 defendant to have new interactions with the law. CBS News' Scott MacFarlane

John Banuelos, who was accused of shooting a gun into the air during the Capitol riot on Jan. 6, 2021, was granted clemency by President Trump along with nearly 1,600 others. Banuelos, however, is back in court in Salt Lake City and facing charges of sexual assault and kidnapping in Utah. Prosecutors say a DNA test conducted in August linked Banuelos to a 2018 attack.
